All the regulations listed in this site are valid in accordance with EC/2000/31
(EEL 178/1), Greek Law 131/2003 about e-commerce, Greek Law 2251/1994 about consumer’s
protection.

Deviating regulations are valid only, if - perpyrakis.gr has given a written
confirmation. Purchasing conditions of the buyer are hereby contradicted.
3. PRICES, OFFERS, CONCLUSION OF AN AGREEMENT
In our catalogues and price lists, prices are always mentioned inclusive the
value taxes.
With his/her online order, the customer gives a binding purchase offer. This offer
is then from - perpyrakis.gr accepted, if an Item Number has been
assigned for it. Only with the acceptance of the offer, develops a requirement
on supply.
Offers are always free of binding. Conclusions of agreements become obligatory
only by written acknowledgement of - perpyrakis.gr.
If employees give verbal agreements or deliver warranties, which go beyond the
written sales agreement, these require the written acknowledgement of
- perpyrakis.gr.
Price adjustments, technical modifications, mistakes, misprint or intermediate
sale reserve the salesperson expressly for him-/herself.
4. PAYMENT
The type of the payment results from the - perpyrakis.gr set up
ways of payment, that is (please read also the “payment
methods” above):
a) Credit card order through the Greek Bank “EFG Eurobank Ergasias”
(www.eurobank.gr).
b) Transfer on bank account
c) Fax order
d) Cash on delivery (COD – available only for addresses within
Greece)
However, - perpyrakis.gr has the right to require from the customer
another type of payment than the selected in the order, if the credit rating gives
cause for this in the opinion of - perpyrakis.gr. The customer will be informed
from - perpyrakis.gr for this, after the receipt of the order.
5. RETENTION OF OWNERSHIP
The supplied commodity is until the complete payment in the property of - perpyrakis.gr.
6. SUPPLY
- perpyrakis.gr supplies at addresses within Greece and at addresses
within the EU (specific countries: Austria, Belgium, Cyprus, Denmark, Finland,
France, Germany, Greece, Italy, Luxembourg, Nederland, Portugal, Spain, Sweden,
United Kingdom) only after the complete payment is handled on delivery (only for
Greece), with transfer on bank account or with credit card.
For jewellery which is characterized as unique, we cannot give warranty for a
supply. Since unique pieces are available for a limited period, it can occur that
despite of the constant updating of our catalogue, the concrete piece is already
sold. The order of unique pieces corresponds to a reservation.
7. SHIPPING EXPENSES
Regardless of the commodity value or the type of the shipment, the customer carries
the full shipping costs. These costs depend on type of the dispatch and on the
shipping address.
Transit way and - type are left to the selection of - perpyrakis.gr.
Specifications about the delivery-time are noncommittal, as far as the date of
the delivery was not exceptionally obligatory assured.
8. RIGHT OF REVOCATION, RETURN RIGHT
The customer has an entitled right of revocation and a right of return. The revocation
does not have to contain a reason and it must take place in written or another
permanent data carrier or by return of the commodity within ten days after receipt
of the supply; for keeping the time limit, it is sufficient the punctual sending.
On commodity return, which has a total value of € 50,00 and over, the customer
must send this as a particular secured value consignment, e.g. as value parcel.
The commodity must be in perfect status and original-packed. All returns travel
at danger and costs of the sender. For damages of the commodity between distribution
and return at - perpyrakis.gr is the customer responsible.
9. INDICATION OF DEFECTIVENESS, GUARANTEE
The product representation can deviate from the appearance of the supplied products,
especially regarding colour and size (please read also the first paragraph of
“Terms & Conditions”). Objections or false supplies have to be reported from
the customer immediately, at the latest within 10 days after receipt of the commodity
at the destination.
If the commodity is defective, - perpyrakis.gr can, after own
selection with in reasonable time eliminate the defects, arrange a replacement
or reduce the price.
In the aforementioned cases, the customer has to send the commodity immediately
back at his expenses to - perpyrakis.gr. The salesman reserves himself a check
of the indicated defect and refunds to the customer the costs of the dispatch
in case of a justified defect-indication.
Transport damages must be clarified directly with the feeder.
Repairs of Watches, Values and Accessorises, which are executed on customer's
request and aren't content in the guarantee to take place, won't be executed at
- perpyrakis.gr, but passed on to external Enterprises/Manufacturers.
For this - perpyrakis.gr takes neither costs nor liability.
10. LIABILITY
The liability of - perpyrakis.gr depends exclusively on the agreements made
in the aforementioned paragraphs. Claims for damages of the buyer from culpability
at agreement’s conclusion, violation of agreement’s obligations and prohibited
activities are excluded, except they are based on rough culpability
of - perpyrakis.gr. This limitation of liability applies according to the buyer.
The buyer carries the exclusive liability for the special and professional use
of the bought commodities. Especially for Timepieces has to be considered the
instructions of the manufacturer.
11. DATA SECURITY
The data of the customer are stored by electronic data processing and will be
passed on third persons, only if it is necessary for the transaction (e.g. bank,
shipping company), with previous information of the consumer.
12. PLACE OF FOUNDATION
The whole sale procedure is governed by and construed under the Greek Law and
the legal relations of the parties hereto are determined in accordance with the
Greek Law. Place of foundation and area of jurisdiction for any dispute resolution
is 741 00 Rethymno, Crete, Greece.
13. OTHER
If part of these trading conditions should be futile for any reason, the validity
of the remaining agreement contents is not influenced.
Fraud and attempted deceits lead to the immediate lawsuit and to the introduction
of a criminal procedure.
